Terry’s expertise

• Terence (Terry) specialises in and practices in general personal injury law, aircraft accident claims, defamation law, commercial litigation and wills and estate litigation. Terry also advises registered clubs.

Terry is primarily based at our Sydney office, but sees clients in other Turner Freeman offices and supervises the Wollongong office.

Terry joined Turner Freeman in June 1986 as a solicitor and became a Partner in May 1995.

Ground breaking cases Terry has been involved in:

• Petty and Maiden v. The Queen in the High Court – a case about the common law right to silence of the accused.
• Taylor v Francoif in the Court of Appeal – the first major case about when a plaintiff was able to bring a proceeding in Court under the Motor Accidents Act 1988.
• Hans Unger v Qantas Airways Ltd – a District Court case reported around the world in respect of the liability of an airline for injury to a passenger during boarding.
• Fleming v. Marshall – a private international law case in the Court of Appeal about whether a New South Wales Court was a convenient forum in respect of a breach of retainer and fiduciary duty claim against New York lawyers.
• Beckett v State of New South Wales – a decision of the High Court in 2013 which over turned a 90 year old precedent requiring a person making a claim for damages for malicious prosecution in the circumstances of Ms Beckett to prove her innocence. The High Court held that Mrs Beckett was not required to prove her innocence.

Amalgamation of registered clubs

Terry also acted in the only ever contested application for an amalgamation of registered clubs heard by the now defunct Licensing Court. He acted for The Gymea Bowling and Recreation Club Ltd and the Miranda Builders and Businessman’s Club Ltd in their application for conditional approval of an amalgamation, which was challenged by the Sutherland District Trade Union Club Limited. The application for the approval of that amalgamation was successful and approved over the opposition of the Sutherland District Trade Union Club Limited and the Miranda RSL Sub-branch Club Limited, two gigantic local clubs in the same area as the Gymea Bowling and Recreation Club Ltd and the Miranda Builders and Businessmen’s Club Ltd.

Defamation Law

Terry has recently acted for Kim Ahmed in her heroic defamation case in the Supreme Court against Ray Hadley and Harbour Radio Pty Ltd, the licensee of Radio 2GB in which Mrs Ahmed successfully sued Ray Hadley and 2GB and obtained a verdict of $280,000 together with interest and costs.

Personal Injury Law

Areas of law in which Terry acts regularly include workers compensation claims, common law claims, equity cases, medical negligence claims, public liability claims, catastrophic injury claims, including brain damage, quadriplegia and paraplegia claims, recovery of money by liquidators and bankruptcy trustees, professional negligence claims, wills and estates and family provision claims.

Airline accident litigation

Terry also acts in claims for injured airline passengers in Australian Courts and in Courts in the United States, including cases in the State Court of Cook County Illinois, a centre for airline accident litigation arising out of crashes around the world.
